These terms apply when you use onfly.agency or engage OnFly Agency ("OnFly", "we", "us") for services. By using the site or engaging our services you accept these terms.
Our services
OnFly provides web development, brand identity and design, and WhatsApp automation services. The exact scope, deliverables, timeline, and price for any engagement are defined in the written quote or proposal we prepare for you, which together with these terms forms the agreement.
Quotes and payment
Quotes are valid for 30 days unless stated otherwise. Work begins after you accept the proposal and pay any agreed deposit. Remaining payments follow the milestones in the proposal. Prices are quoted in the currency stated in the proposal.
Client responsibilities
You agree to provide the content, access, feedback, and approvals we reasonably need to deliver on time, and to use our deliverables only for lawful purposes. Delays in providing materials or approvals may extend the timeline.
Intellectual property
Once the project is fully paid, ownership of the final deliverables created specifically for you transfers to you. We keep the right to display non-confidential work in our portfolio and marketing unless we agree otherwise in writing. Third-party assets, such as fonts, stock media, and software licences, remain governed by their own terms.
Support and maintenance
Packages include a free support period, typically 3 to 6 months from launch depending on the package, covering bug fixes and minor content updates. New features and redesigns are quoted separately. Ongoing hosting and maintenance beyond the included period are billed as stated in the proposal.
Third-party services
Websites and automations depend on third-party services such as hosting, domain registrars, payment gateways, and the WhatsApp platform. Those services are governed by their own terms, and we are not responsible for their outages, pricing changes, or policy changes.
No guarantee of specific results
We build to a high standard and follow good SEO and performance practice, but we cannot guarantee specific business outcomes, such as search rankings, traffic, or sales.
Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from a service is limited to the fees you paid for that service, and we are not liable for indirect or consequential losses, such as lost profits or lost data.
Termination
Either party may end an engagement with written notice as set out in the proposal. You remain responsible for paying for work completed up to the end date.
Governing law
These terms are governed by the laws of Malaysia, and disputes are subject to the jurisdiction of the Malaysian courts.
